Exceptions to the Czech Citizenship Residence Requirement – Are You Eligible?

Your Path to Czech Citizenship – Residence Requirement and Possible Exceptions

Don’t meet the usual length of the Czech citizenship residence requirement? Good news – you might not have to!

Czech law allows certain applicants with strong ties to the Czech Republic to receive citizenship sooner, even if they haven’t met the standard years of permanent residence.

Standard Residence Requirements     

Under Czech law, citizenship may be granted if the applicant holds permanent residence (“trvalý pobyt”) in the Czech Republic continuously as of the date of application:

  • for at least 5 years

Gabriel is from Brazil, and he moved to the Czech Republic for work. He was eventually granted permanent residence on 1 December 2020. He becomes eligible to apply on 2 December 2025

  • for at least 3 years, if the applicant is a citizen of an EU Member State

Manon is from France, and she moved to the Czech Republic with her Czech husband. She was granted permanent residence on 1 December 2022. She becomes eligible to apply on 2 December 2025

  • for a combined total of at least 10 years, counting both your permanent residence and the immediately preceding legal stay.

Yusuf is from Turkey, and he came to the Czech Republic to study on 1 September 2015, based on a student visa. Right after finishing his studies, he found a job in Prague and stayed based on an employee card. He was granted permanent residence only on 1 October 2025.  Nevertheless, he may already be eligible, without fulfilling 5 years of permanent residency, because he has stayed here lawfully for more than 10 years and holds permanent residency at the moment.

Can you qualify for an Exception?

If you already have permanent residence in the Czech Republic, you may be eligible for a waiver of the standard length-of-residence requirement if any of the following apply:

  1. You were born in the Czech Republic

Being born on Czech territory creates a lifelong bond and the law recognizes this connection.

  1. You are, or once were, a Czech (or former Czechoslovak) citizen

Previous citizenship represents a strong historical tie that can significantly shorten your path back to citizenship.

  1. At least one of your parents is a Czech citizen

Family roots matter. Even if you’ve spent years abroad, your parents’ citizenship could bring you much closer to your own.

  1. You were adopted by a Czech citizen after age 18

Adoption establishes a meaningful personal and legal bond that the state respects.

  1. Your spouse (or registered) partner is a Czech citizen

Sharing a home and life with a Czech partner can make your path faster and easier.

  1. You are under 18 years old

Minors receive additional protections and may access citizenship more quickly.
